- In the matter of Motor Dealer Act R.S.B.C. 1996 C.316
- Complainant: Vehicle Sales Authority of BC
- Licensee/Unlicensed person:
Imad Abdullah Rashid c.o.b. as Imad Rashid (Unlicensed)
The Authority requested a hearing, based upon allegations and evidence that Imad Abdullah Rashid c.o.b. as Imad Rashid (“Mr. Rashid”) had been engaged in selling numerous motor vehicles without being a registered motor dealer (“curbing”).
The Authority also alleged Mr. Rashid did not make declarations required by the legislation, which is also deemed to be a deceptive act or practice.
On June 20, 2019, the Registrar found that Mr. Rashid committed deceptive acts or practices and imposed an Administrative Penalty of $35,000 and found that the Authority was entitled to recover its investigative costs.
On July 22, 2019, Mr. Rashid sought reconsideration of the Registrar’s decision.
The Registrar found that Mr. Rashid had provided no new evidence on which to base a reconsideration of his prior decision.
The Registrar found that, even if the information that Mr. Rashid did provide had been new, those facts failed to show how they would have materially or substantially affected the Registrar’s prior decision.
The Registrar denied Mr. Rashid’s application for reconsideration.
